Rachel Berlin Benjamin is a fierce advocate and tenacious litigator with extensive experience winning cases before state, federal and appellate courts. She fights tirelessly to restore the rights of employees who have experienced unlawful discrimination and retaliation, sexual harassment, wrongful termination, wage theft and other workplace injustices.
Taking pride in providing clients with high-quality and compassionate representation, Rachel specializes in obtaining remedies for employees subjected to sexual harassment at work, going up against high-profile harassers and negotiating seven-figure settlements for her clients.
In the aftermath of the “me too” era, Rachel also specializes in representing sexual harassment and assault victims in highly-sensitive and high-profile cases. In 2021, she negotiated a $1 million settlement in a sexual harassment lawsuit involving the Jesup Police Department and its former police chief and is passionate about advocating for victims’ rights and helping her clients navigate such difficult circumstances.
Rachel has trial experience in a diverse array of litigation matters. She and her former partner won a substantial jury verdict in a week-long age discrimination trial, including all of the plaintiff’s lost wages and the maximum damages allowed by law. Currently, she represents Mexican workers in an employment discrimination class-action lawsuit against a Hyundai subsidiary in Georgia for exploiting migrant workers through fake job offers.
She has also taken on the Atlanta Police Department’s refusal to change its facial hair policy, which prevented officers from serving and protecting their communities. This victory paved the way for similarly situated police officers to continue proudly serving the people of Atlanta.
Rachel has achieved considerable successes before the Eleventh Circuit Court of Appeals, including drafting the appellate brief that convinced the judges to revive a school bus driver’s disability claim and playing a critical role in the revival of an age discrimination lawsuit and a Title VII retaliation case.
Before moving her practice to Atlanta, Rachel was a Bronx Assistant District Attorney in New York, where she prosecuted misdemeanors and violent felonies, conducted hearings and trials, negotiated pleas, and presented cases to Grand Jury panels for indictment.
Rachel graduated magna cum laude from Pace Law School and received her Bachelor of Arts degree from Sarah Lawrence College. She is a member of the State Bars of Georgia and New York, the U.S. Court of Appeals for the Eleventh Circuit, and federal district courts in New York and Georgia. She is also a member of the National Employment Lawyers Association and is passionate about raising money to help find a cure for Parkinson’s Disease.
In her free time, Rachel enjoys exploring Atlanta, spending time with her husband and two young children, attending live concerts and comedy shows, and visiting her family in New York.
